Terms of Service

These terms apply when a Shopify merchant ("you") installs and uses Smart Sphere POS ("the App"), provided by Smart Sphere ("we").
1. The service
The App is a point-of-sale system connected to your Shopify store: selling at your branches, receipts, shifts and cash drawers, refunds, customers and loyalty, delivery app orders, tax and reports.
2. Plans and billing
- Plans, prices and limits are shown in the App inside Shopify admin and on our App Store listing.
- Charges are billed by Shopify on your Shopify invoice, every 30 days, after the free trial.
- You can change or cancel your plan at any time from Shopify admin; uninstalling the App cancels it.
- Fees already charged are not refunded, except where the law requires it.
3. Your responsibilities
- Keep staff accounts and passwords safe, and give each employee the right role.
- Check your prices, taxes and receipts comply with the rules where you sell. Tax settings are yours to configure.
- Count and reconcile your cash. The App helps you control the drawer; it does not guarantee the cash in it.
- Obtain any consent needed from your customers for the data you enter (for example their phone number for loyalty).
4. Your data
Your store's data remains yours. We process it only to provide the App, as described in our Privacy Policy. After you uninstall, it is deleted as described there.
5. Availability
We work to keep the App available and to keep your data safe, but the App depends on the internet, on Shopify and on our hosting provider. If Shopify cannot be reached, sales are kept in the App and sent later (see Admin > Shopify Sync).
6. Acceptable use
Do not use the App for anything illegal, to break the Shopify terms, or to try to access another store's data.
7. Liability
To the extent the law allows, the App is provided "as is", and our total liability for any claim is limited to the fees you paid for the App in the three months before the claim. We are not liable for indirect losses such as lost profits.
8. Changes and ending
We may update these terms and will post changes here. You may stop using the App at any time by uninstalling it. We may suspend a store that breaks these terms, after notice when possible.

تنطبق هذه الشروط عندما يثبّت تاجر على Shopify («أنت») تطبيق Smart Sphere POS («التطبيق») المقدَّم من Smart Sphere («نحن») ويستخدمه.
١. الخدمة
التطبيق نظام نقطة بيع مرتبط بمتجرك في Shopify: البيع في الفروع، الإيصالات، الورديات ودرج النقد، المرتجعات، العملاء والولاء، طلبات تطبيقات التوصيل، الضريبة والتقارير.
٢. الخطط والفوترة
- الخطط وأسعارها وحدودها معروضة في التطبيق داخل لوحة Shopify وفي صفحة التطبيق في App Store.
- يُحصّل Shopify الرسوم ضمن فاتورتك كل 30 يوماً بعد انتهاء التجربة المجانية.
- يمكنك تغيير الخطة أو إلغاؤها في أي وقت من لوحة Shopify، وإلغاء تثبيت التطبيق يلغيها.
- الرسوم المحصّلة لا تُسترد إلا حيث يفرض القانون ذلك.
٣. مسؤولياتك
- حماية حسابات الموظفين وكلمات المرور، وإعطاء كل موظف الدور المناسب.
- التأكد من أن الأسعار والضرائب والإيصالات تطابق الأنظمة في بلدك؛ إعدادات الضريبة مسؤوليتك.
- عدّ النقد ومطابقته؛ التطبيق يساعدك في ضبط الدرج ولا يضمن النقد الموجود فيه.
- الحصول على موافقة عملائك على البيانات التي تُدخلها (مثل الهاتف لبرنامج الولاء) حيث يلزم.
٤. بياناتك
بيانات متجرك ملكك. نعالجها فقط لتقديم التطبيق كما في سياسة الخصوصية، وتُحذف بعد إلغاء التثبيت كما هو موضّح هناك.
٥. التوفّر
نعمل على إبقاء التطبيق متاحاً وبياناتك آمنة، لكنه يعتمد على الإنترنت وShopify ومزوّد الاستضافة. إذا تعذّر الوصول إلى Shopify تُحفظ المبيعات في التطبيق وتُرسل لاحقاً (الإدارة ← المزامنة مع Shopify).
٦. الاستخدام المقبول
لا تستخدم التطبيق لأي غرض غير قانوني أو مخالف لشروط Shopify، ولا لمحاولة الوصول لبيانات متجر آخر.
٧. المسؤولية
في حدود ما يسمح به القانون، يُقدَّم التطبيق «كما هو»، وتقتصر مسؤوليتنا الكلية عن أي مطالبة على الرسوم التي دفعتها في الأشهر الثلاثة السابقة لها. ولا نتحمّل الخسائر غير المباشرة مثل فوات الأرباح.
٨. التعديل والإنهاء
قد نحدّث هذه الشروط وننشر التعديلات هنا. يمكنك التوقف في أي وقت بإلغاء التثبيت. وقد نوقف متجراً يخالف هذه الشروط، بعد إشعار متى أمكن.
